These terms govern your use of Instructron's educational services and tools.

Welcome to Instructron, operated by Instructron, Inc. ("Instructron", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the websites, applications, and services provided by Instructron (collectively, the "Services").

Our mission is simple: Help teachers support every student—efficiently, ethically, and with tools that actually make a difference.

Definitions

  • Services includes our website, applications, learning tools, and any additional electronic materials provided by Instructron.
  • Educators refers to individual teachers using the platform in classroom or tutoring environments.
  • AI Tools refers to Instructron's generative features such as instant coaching feedback, test generation, report cards, and similar capabilities.

1. Who Can Use Instructron

Age Requirement

To use Instructron, you must be at least 18 years old and agree to these Terms.

Educational Institutions

If you're using the Services on behalf of a school, district, or other educational institution ("Educational Institution"), you represent that you have the authority to bind that institution to these Terms.

If you use our student-facing tools as part of your instruction, your use may be subject to additional agreements between us and your Educational Institution.

2. Your Account and Responsibilities

Account Security

  • Provide accurate and complete information
  • Keep your login credentials secure
  • You're responsible for any activity under your account

Usage Rights

  • Limited, non-exclusive, non-transferable right
  • Solely for educational purposes
  • No sharing accounts with others
  • No building competing tools

License & Fair Use Policy

Each paid account is licensed for use by a single educator and their students.

  • Sharing accounts across multiple teachers, staff, or departments is not allowed and may result in account suspension.
  • For school, district, or organization-wide access, contact us about partnership options or multi-license plans.
  • We offer generous plan limits designed for real classroom use. If you need clarification or a customized setup, we are happy to help.

AI Usage Policy

Premium includes generous access to all AI tools. While we do not charge per use, excessive or non‑classroom activity that affects service quality may trigger limits under our Fair Use policy. Typical classroom usage is fully covered.

What happens if limits are exceeded? Excessive usage may result in temporary throttling, reduced response speed, or a review of account activity. For most educators using the platform appropriately, these limits will never be reached.

Plan comparison: Essentials adds 100 AI credits to your balance each month (credits roll over while your account is active). Premium includes unlimited AI usage under Fair Use. We define generous, reasonable thresholds to ensure quality for all users.

We reserve the right to interpret and enforce Fair Use limits at our sole discretion to maintain a high‑quality experience for all users.

3. Student Data and Privacy

We take data privacy seriously. Our Trust & Privacy page outlines exactly how we collect, store, and use data—and what we don't do.

Your Responsibilities

  • Obtain necessary consents under FERPA and COPPA
  • Don't input personally identifiable student information without proper agreements
  • Ensure compliance with your institution's policies

4. AI-Generated Content

AI as a Tool

Instructron uses AI to help you and your students work smarter. But AI isn't a replacement for your professional expertise.

Your Responsibility

  • Review and revise all AI-generated output
  • Don't rely on Services for legal, medical, or safety decisions
  • Understand AI content may include errors or bias

5. Prohibited Uses

You may not use the Services to:

  • Violate any applicable law or regulation
  • Infringe on intellectual property or privacy rights
  • Harass, threaten, or harm others
  • Introduce viruses or disrupt our systems
  • Attempt to gain unauthorized access
  • Develop commercial products outside educational use
Violation of these rules may result in suspension or termination of your account.

6. Intellectual Property

Our Rights

All content, trademarks, and software associated with the Services are owned by Instructron or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

Your Content

You retain ownership of any content you input or upload, but by submitting it to Instructron, you grant us a license to use that content to provide and improve our Services.

7. Termination

You May Stop Using

You may stop using Instructron at any time.

We May Suspend or Terminate

Instructron may suspend or terminate your account if you violate these Terms or misuse the platform. In most cases, we will notify you and provide an opportunity to resolve the issue before permanent action.

However, we reserve the right to take immediate action in cases of severe abuse (for example, automated scraping, account sharing, attempts to bypass security controls, or activity that harms service quality for others).

8. Disclaimers

Service Availability

We provide our Services "as is," without warranties of any kind. We don't guarantee the Services will be uninterrupted, error-free, or perfectly suited for every classroom use.

To the fullest extent permitted by law, Instructron shall not be liable for indirect, incidental, or consequential damages arising out of your use of the Services.

9. Indemnification

You agree to indemnify and hold harmless Instructron and its officers, employees, and affiliates from any claims or liabilities arising out of your misuse of the Services or violation of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above and provide notice as required by law. Continued use of the Services after any changes means you agree to the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
